In his extensive experience, Héctor has obtained favorable rulings that have set important precedents in national legislation.

An example of this was an ordinary civil trial in which an European Clinic for Assisted Reproduction (client) was sued for non-economic damages for an alleged heterotopic pregnancy (when an embryo coincides in time intrauterine and another extrauterine) caused to the patient, demonstrating in the trial that said circumstance was an inherent risk to the procedure itself and of which the patient had previously been notified, in addition to the fact that there was evidence in the clinical file that the patient had only had one embryo implanted, also proving with international literature that the only embryo implanted in the patient could have divided, hence the average responsibility (medical care) and the Lex Artis Ad Doc had been met, so the accusation of medical responsibility was inadmissible.

Miguel, is a lawyer graduated from UNAM in 1971, who has dedicated his entire life to labor consulting for companies. Throughout his professional life, he has founded several law firms in the labor law specialty and is currently a partner and leader of the labor area of the firm Macdonel, Uribe, Cuesta, Llaca and Esquivel Abogados. 

He has litigated more than 50 years to date and has intervened or been responsible for more than 150,000 individual and collective labor lawsuits. He has been a lawyer for countless companies, organizations and institutions, from the private and public sectors, among which are the Public Education Ministry, Health Ministry and CONADE. 

Due to his correct perception of the nature of the labor trials in Mexico, he deduced, since 1980, the need to create an evidentiary protocol, with which companies can protect themselves from the enormous vulnerability generated by Mexican labor legislation, motivated by the burden of proof in the judicial proceedings in this area, which implies enormous economic losses to the employer sector; obtaining with it, a legal shield that has motivated the recognition of the clients.

  • As for his contributions in the administration of human resources, since 1980 he designed the first work contracts with hourly pay, distance work (home office), monthly salary payments, reduced hours, discontinuous work, and implemented the homologation of technological innovations in the administration of human resources, to provide them with evidentiary efficiency in court, when neither the jurisprudence nor the Mexican labor and social security legislation had contemplated these concepts.

    His work philosophy is to generate all the legal supports in the administration of human resources, to prevent the risks of labor conflicts, for which it has created collective and individual contracts and labor documents with all the concepts of innovation, which generally represent savings to the companies.

  • The litigation area headed by Mr. García Macdonel, has provided his services to several factors in the Insurance and Bonding sector, among which stands out one of the largest insurance companies in the world, which he has sponsored in more than 500 commercial trials nationwide, as well as has sponsored more than 100 processes in criminal matters in various states of the republic, which makes him one of the most recognized lawyers in the Insurance and Bonding sector.
  • One of the most significant matters that our litigation partner has resolved was that of a multi-insured who, shortly after taking out life insurance policies with eight insurance companies, died abruptly. The investigation conducted by our criminal litigation team led to the conclusion that this was a fraud to the detriment of the insurance companies. Due to the intervention of Mr. Garcia Macdonel, our client was able to avoid being charged a large amount of money for the sum insured. Due to the success of the investigation, the Mexican Association of Insurance Institutions (AMIS) organized a meeting for our litigation partner to present the case, which helped more companies to avoid the payment of a claim that was unjustified.
  • Mr. Garcia Macdonel advised another of the largest insurance companies in the world in a matter arising from the use of a false document for the improper collection of a Life Insurance that had a sum insured of more than USD$5,000,000 (five million U.S. dollars). Within the documentation with which the beneficiary accompanied the claim, an altered death certificate was found. Based on the foregoing, Mr. García Macdonel filed a criminal complaint through which he not only obtained the suspension of the commercial lawsuit through which they intended to collect the insured amount, but also obtained that a Criminal Judge issued and executed an arrest warrant against the beneficiary who attempted to defraud the insurance company. This was part of an integral strategy in which the litigation areas in which Eliser specializes were combined.
  • Our litigation partner advised a German auto parts company based in Tlaxcala, due to the fact that employees of the company, particularly in the accounting area, carried out several unjustified transfers to their payroll accounts. After the complaint was filed, a judge issued an arrest warrant against both employees, concluding the process with a conviction by which the company was repaired.
